This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 456 dated 25.12.2012 under Sections 395 & 397 IPC and section 25 of the Arms Act at Police Station Meham, district Rohtak. Learned State counsel, on instructions from SI Ram Niwas, who is present in court, submits that out of the twenty one witnesses cited by the prosecution, twenty have already been examined.

In view of above, counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to file afresh in case trial does not conclude within a period of four months.
