Through the instant petition, the petitioner prays that on account of illegal mining activities becoming undertaken in the area concerned, thereby deleterious consequence have ensued to the environment. Therefore, the petitioner, thus claimed the passing of a mandamus upon the respondent concerned, to ensure that the mineral concessionaire concerned, be brought to book through appropriate measures, in accordance with law, becoming drawn against him. 2.

Learned Sr. DAG, Punjab has placed on record, the detailed reply on affidavit, sworn by the District Mining Officer-cum-District Mining Officer-cum-Executive Engineer/Pathankot Drainage-cum-Mining and Geology Division, Water Resources Department, Pathankot, whereins, SATYAWAN 2024.05.25 04:47 I attest to the accuracy and integrity of this document

CWP-6724-2024 (O&M) in paragraph 6 thereof, it has been stated that an FIR bearing No. 29 dated 09.04.2024 under Section 21(1) Mines and Minerals (Development and Regulation) Act, 1956 and 379 IPC has been registered against the Mineral Concessionaire concerned, who has indulged in illegal mining activities in the zone concerned.

It is further stated in the said reply on affidavit, that proceedings under the relevant rules have been also invoked against the said Mineral concessionaire, for therebys the requisite penalties becoming recovered from him.

In the wake of the above, since the respondents concerned have ensured the recoverings of penalty from the mineral concessionaire concerned, who has allegedly indulged in illegal mining activities in the zone concerned, therefore, the learned counsel for the petitioner prays and is permitted to withdraw the present petition. Accordingly, the present petition is disposed of besides is closed at this stage 5.
