Petitioners have sought quashing of order, Annexure P5 whereby trial court had issued non-baliable warrants for their arrest. Learned counsel for the petitioners submits that order is against law and deserves to be quashed.

I have heard learned counsel for the petitioners. It appears that on a complaint lodged by one Naranjan Singh, FIR was registered under sections 323, 326, 34 IPC at police station Dasuya. According to learned counsel, initially challan was presented against only one accused and petitioners were shown in column no. 2. During proceedings, application, Annexure P4 was moved by the police for issuance of warrants against the petitioners as they were required for the purpose of investigation. It was also stated therein that efforts had been made by the police to arrest the petitioners but they were absconding. After considering the application, JMIC, Dasuya passed instant order and directed issuance of non-baliable warrants. I find no infirmity with the order passed by the court below.
