On the instructions of ASI Amarjit Singh, it has been informed that the petitioner has joined the investigation. It is also an admitted fact the petitioner was not originally named in the FIR. His name has cropped up during the course of investigation. No specific injury has been attributed to the petitioner.

Learned State counsel has, on the basis of the police record, informed that as per the supplementary statement of Sukhchain Singh recorded on 16.2.2016, the petitioner has also been attributed injuries. Authenticity of the supplementary statement, which is prima facie contrary to the original version in the FIR and his earlier statement, will certainly be a debatable issue during the course of trial. Other 9 co-accused have already been arrested.

Accordingly, the petition is allowed and interim order dated 22.1.2016 is hereby confirmed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
