ARUN MONGA, J. (ORAL) CM-6935-CWP-2022 For the reasons stated in the application, orders dated 28.07.2021 and 03.09.2021 contained at Annexures P-6 and P-7 are taken on record, subject to all just exceptions.
MAIN CASE Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to consider the claim of the petitioner and reinstate him in service and further his services be considered in continuation with effect from 05.04.2021. 2.
Petitioner was offered appointment as Ward Servant vide letter dated 03.04.2021 by replacing one Sonu. He joined his service on 01.07.2021 and worked on the said post diligently. Vide letter dated 19.01.2022 (Annexure P-3), services of the petitioner were terminated without issuing any show cause Notice.

In these circumstances, petitioner served legal notice dated 31.03.2022 (Annexure P-5) but the same has not been adverted till date. Hence the petition.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the legal notice dated 31.03.2022 (Annexure P-5) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending legal notice, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the legal notice dated 31.03.2022 (Annexure P-5) of the petitioner and pass an administrative order, in accordance with law, as expeditiously as possible.

Disposed of accordingly.
