******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 117 dated 28.11.2015 registered for the offences punishable under Sections 307, 506, 148 read with Section 149 of Indian Penal Code (for short IPC) and 25, 27 of Arms Act at Police Station Ajitwal. Heard.

Learned State counsel on instructions from HC Sohan Singh submits that the petitioner was found innocent and his name was kept in column No. 2 of the challan. He was summoned by the trial Court on the application of prosecution under Section 319 Cr.P.C. as an additional accused to face trial for the offences punishable under Sections 148, 307, 506 read with Section 149 IPC.

CRM-M-23821-2017 -2Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and has been allowed interim bail in terms of order dated 07.07.2017 passed by this Court. Keeping in view the above fact but without expressing any opinion on the merits of the case, this petition is allowed and the order dated 07.07.2017 is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing. In the event of his non-appearance on any date, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and to take the petitioner into custody.
