(ORAL) On instructions from ASI Harbans Singh, learned State counsel assisted by learned counsel for respondents No. 2 to 4 submits that the instant petition has rendered infructuous, in view of the fact that all accused-respondents No. 2 to 4, namely; Sarabjit Singh @ Makhan, Manjit Singh and Avtar Singh, in case FIR No. 49 dated 09.11.2006, under Sections 420, 464 and 120-B IPC, Police Station Fatehgarh Sahib, District Fatehgarh Sahib, have been acquitted by the trial Court, vide judgment dated 23.11.2015.

CRM-M-23855-2014 -2submits that proceedings under Section 340 Cr.P.C., against PW-5-Gurmail Singh, have also come to an end and appeal of the petitioner, against the aforesaid judgment of acquittal is pending before the Ist Appellate Court.

In view of the above, the instant petition is dismissed as having rendered infructuous.
