RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.20 dated 14.02.2019 registered under Section 420 IPC, Section 13 of the Punjab Prevention of Human Smuggling Act, 2012 and Section 24 of the Immigration Act, 1983 at Police Station City Nawanshahar, District SBS Nagar.

According to the prosecution, petitioner along with his accomplice Sukhdev Singh allured the complainant to send her husband abroad on work visa on payment of Rs.1.70 lakh. Consequently, complainant paid Rs.1.50 lakh to send her husband abroad, whereupon, he was sent to Malaysia by the petitioner and his aforesaid accomplice on visitor visa. Therefore, husband of the complainant was arrested by the Malaysian police and sent to jail.

-2CRM-M-12857 of 2019 petitioner has been implicated falsely. There is no allegation against him that he ever took money from the complainant. He is innocent. On the other hand, learned State counsel vehemently opposed the bail application of the petitioner.

Having given thoughtful consideration to the rival submissions and considering the seriousness of allegations, this Court finds the instant petition completely meritless, inasmuch as noticing the problem of unemployment and weakness of the people of Punjab to go abroad to earn their livelihood, petitioner and his accomplice allured the complainant. This illicit trade has increased manifold in the recent past. Therefore, no ground is made out to grant concession of anticipatory bail to the petitioner. Dismissed.
