HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.0134 dated 21.12.2020 under Section 22 of NDPS Act (Section 61 of NDPS Act has been added later on) registered at P.S Garhdiwala, Hoshiarpur. Allegations against the petitioner are that he was found in possession of 110 grams of Alprazolam.

Learned counsel for the petitioner contends that false recovery has been foisted upon the petitioner. No other criminal case is registered against the petitioner and that the petitioner has been in jail since 22.12.2020. Investigation is complete and challan has been filed. On the other hand, learned State counsel submits that out of eight PWs, none has been examined so far.

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial of the case is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition is allowed. The petitioner Maninder Kumar @ Mani is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
