******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 32 dated 18.02.2015 registered for the offence punishable under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Shahkot, District Jalandhar.

Heard.

Learned counsel for the petitioner submits that the petitioner has since joined the investigation. He has raised the plea that at the time of registration of FIR, the petitioner was living in Qatar, however, his Visa to Qatar had already been expired in the year 2015 but he continued living in Qatar and returned on 13.10.2016. Entry to this effect was made in his passport copy of which he has supplied to the police and this fact can be verified.

As per case of prosecution, recovery of contraband was made from possession of Lovepreet Singh and Karamjit Singh. Allegation against Jitender Kumar 2017.03.24 17:53 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-2388 of 2017 -2the petitioner is that the motorcycle on which Lovepreet Singh and Karamjit Singh were travelling belongs to him.

Learned State counsel submits that the petitioner has joined the investigation and his custodial interrogation is no more required. Keeping in view above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 25.01.2017 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
