**** RITU BAHRI , J. (Oral) The petitioner was selected as Extension Lecturer on 04.08.2014 in the subject of Economics by a duly constituted committee. But now vide impugned order dated 06.03.2019 (P-2), the petitioner has been relieved just to adjust respondent No. 4, who was working as Associate Professor in Gandhi Memorial National College, Ambala Cantt. Respondent No. 4 has been sent on deputation till 31.12.2019 and petitioner has been relieved. Learned counsel submits that the impugned order is liable to be set aside as firstly the petitioner cannot be relieved in the middle of academic session and further she cannot be replaced by way of deputation. Petitioner is relying upon judgments of this Court in a case of Mamta Rani and others vs. State of Haryana and others, decided on 09.10.2018, passed in CWPNo. 26077-2018 (P-7) and Rashmi vs. State of Haryana and others, decided on 11.03.2019, passed in CWP No. 5141-2019 (P8) Issue notice of motion.

CWP No. 7737-2019 notice on behalf of the State. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself. Keeping in view the above fact, the present petition stands allowed and order dated 06.03.2019 (P-2) is set aside. Respondent No. 3 shall immediately take the petitioner back into service as an Extension Lecturer. Further it is made clear that if some new regular candidates joins, the petitioner can be relieved on the basis of last come first go, in view of Mrs. Rita Tondon vs. State of Haryana and others, passed in CWP No. 16975-2014, decided on 29.07.2016.
