-.- JAISHREE THAKUR J. (ORAL) On receipt of application received from Bindu Bala wife of Parveen Kumar resident of House No.787, Chhata Bazar, Hoshiarpur with an allegation that her son namely Shivai Rai had been forcibly taken away by SHO and other police officials, the same has been entertained as writ of habeas corpus under Article 226 of the Constitution of India. Notice of the said petition was issued to the State of Punjab and a reply was sought in the said matter.

Pursuant to the said notice, a status report has been filed by way of affidavit of Jagdish Raj, PPS, Deputy Superintendent of Police, SubDivision City, Hoshiarpur, which would reflect that the matter has been investigated and it has been found that son of the petitioner has been arrested in FIR No.158 dated 09.10.2018 under Sections 324, 323, 379-B, 148, 149 IPC registered at Police Station City, Hoshiarpur and Section 307 IPC, which was subsequently added on 26.02.2020. Learned counsel appearing on behalf of the State of Punjab submits that as per the information available, there are several cases registered against sons of the petitioner, details of which are enumerated in para 8 of the status report.

CRWP No.3063 of 2020 -2I have heard learned counsel for the State and have also perused the status report as filed. In view of the fact that son of the petitioner stands arrested in FIR No.158 dated 09.10.2018 under the aforesaid sections and is in judicial custody, no further orders are called for in the instant petition.

Disposed of accordingly.
