On 21.04.2022, the following order was passed:- "Learned counsel for the petitioner inter-alia contends that the petitioner has been falsely implicated in the case on account of a matrimonial discord between the petitioner and the complainant; the petitioner has no other criminal case pending against him; the allegations of demand of dowry are absolutely vague and unsubstantiated; the allegations of beatings by the petitioner are not backed by any medical record; the story set up by the complainant with regard to the petitioner having relations with other woman is also vague and false with no evidence to back such allegations; no recovery is required to be made from the petitioner and that the petitioner is also ready and willing to join and cooperate with the investigation. Notice of motion for 01.09.2022.
Mr.Kirat Singh Sidhu, Deputy Advocate General, Punjab, accepts notice on behalf of the respondent No.1-State. Notice be issued to respondent No.2 through ordinary process. In the meanwhile subject to the petitioner's joining investigation as and when called by the investigating agency as also abiding by PARVINDER SINGH 2024.01.30 17:44 I attest to the accuracy and integrity of this document chandigarh
CRM-M-15148 of 2022 (O&M) 2024:PHHC:012513 the other conditions provided under Section 438(2) Cr.P.C, in the event of his arrest in FIR No.39, dated 24.03.2022, registered under Sections 498-A IPC at Police Station Longowal, District Sangrur, he shall be released on ad interim anticipatory bail to the satisfaction of the Arresting Officer."

Learned State counsel on instructions from HC Sandeep Kumar has stated that pursuant to the order dated 21.04.2022, the petitioner has joined investigation and is no longer required for custodial interrogation, however, partial recovery has been made.

In view of above, the interim order dated 21.04.2022 passed by this Court is made absolute, subject to the conditions as enumerated under Section 438(2) Cr.P.C.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 438(2) Cr.P.C., 1973 or upon showing any other sufficient cause.

Needless to say that anything observed herein above shall not be construed to be an opinion on the merits of the case.
