**** ANOOP CHITKARA, J. (ORAL) Notice served upon the official respondent through the State's counsel. Learned State counsel has opposed the present petition for quashing of FIR on the ground that the petitioner was named in the FIR. On the contrary, learned counsel for the petitioner submits that later on wife of the complainant has absolved the petitioner and has stated that he was not present.

Be that as it may, this is a subject matter of the investigation and it shall be open for the petitioner to argue this point, before the appropriate Court, in case challan under Section 173 Cr.P.C is filed and prosecution is launched against him. Furthermore, in case, charges are framed, it shall be open for the petitioner to challenge the same and the filing of present petition shall not come in the way. The present petition is having been disposed of with aforesaid liberty. All pending applications, if any, stand disposed of.
