This order shall dispose of the above mentioned two petitions wherein petitioners Ram Parkash and Gurmail Singh, have approached this Court seeking grant of anticipatory bail in respect of a case registered against them vide FIR No.31, dated 4.3.2020, Police Station Garhshankar, District Hoshiarpur, under Sections 406 and 498-A IPC.

The FIR was lodged at the instance of Navjot Kaur wherein allegations have been levelled against the petitioners to the effect that MOHAN SINGH 2020.10.13 20:53 I attest to the accuracy and integrity of this document

CRM-M Nos. 12303 & 20631 of 2020 (O&M) - 2 - they have been maltreating her and harassing her in order to press upon their demand of dowry.

Pursuant to interim directions issued by this Court, both the petitioners are stated to have joined investigation as has been informed by the State counsel upon instructions from SI Rakesh Kumar.

Having regard to the facts and circumstances of the case and bearing in mind that it is a case which has apparently arisen out of some matrimonial discord amongst the parties, custodial interrogation of the petitioners is not warranted. Both the petitions, as such are accepted and interim directions issued vide order dated 14.5.2020 (CRM-M-12303-2020) and 28.7.2020 (CRM-M-20631-2020) are made absolute subject to the condition that the petitioners shall appear and join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C. 4.

Petitioner-Gurmail Singh is however, directed to make efforts to rehabilitate the complainant as had been represented on his behalf at the time of issuance of notice of motion and to opt for some kind of mediation to explore the possibility of compromise.
