H. S. Madaan, J. (Oral) This is a petition for quashing of FIR No. 75 dated 21.4.2018, for offences under Sections 452, 376, 506 IPC, registered at Police Station Talwandi Sabo, District Bathinda, on the basis of compromise.

A perusal of the FIR goes to show that the petitioner is specifically named therein and there are allegations of rape against him. Under the circumstances, the composition of such offence under Section 376 IPC cannot be allowed.

Nevertheless the FIR is still at the stage of investigation and it is yet to be seen whether petitioner shall be sent up to face trial by the Investigating Agency or not. If so advised, the petitioner can raise all these pleas before the Investigating Agency. Finding no merit in the petition, the same stands dismissed. ( H.S.
