This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.50 dated 31.5.2016 registered for the offences under Sections 420 and 120-B IPC at Police Station Kanwan, District Pathankot.

Notice of motion has been issued in this case. Mr. P.S. Paul, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Punjab appearing for the respondentState and have gone through the record. Cr. Misc. No.M-24869 of 2016 [2] From the record, I find that as per the FIR, the allegations regarding cheating the complainant of `36 Lacs for sending him to America are against Ravinder Singh @ Ravi and Jatinder Singh Randhawa. The amount is also demanded by them and mainly paid to them. Only `5 Lacs were stated to have been taken from the house of the complainant by Gurpreet Singh and Rajinder Singh, who is maternal uncle of Jatinder Singh Randhawa. The present petitioners are not the main accused. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I accept this criminal miscellaneous petition and in the event of arrest, the petitioners shall be admitted to bail on their furnishing personal bonds and sureties to the satisfaction of the Arresting/Investigating Officer. The petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
