R.P. Nagrath, J. (Oral) Prayer in the instant petition is made under Section 439 Cr.P.C. for grant of regular bail in FIR No. 28 dated 17.01.2015 for offences 302, 303, 34 and 120-B of Indian Penal Doe (IPC) and Section 25 of the Arms Act, registered at Police Station Mahesh Nagar, Ambala Cantt. District Ambala. As per prosecution story, deceased-Gajender son of the complainant received a phone call on 31.12.2014 for the demand of ransome of ` 2 lacs. The incident took place on 16.01.2015 and as per statement in the nature of dying declaration made by Gajender, Kuldeep Singh @ Kallu husband of the petitioner fired a gunshot hitting him on right thigh and near stomach.

During interrogation of Kuldeep Singh @ Kallu aforesaid disclosed the name of petitioner and four live cartridges were found in possession of the petitioner.

Learned counsel for the petitioner submits that husband of the petitioner was undergoing imprisonment and JITENDER KUMAR 2015.08.25 16:35 I attest to the accuracy and integrity of this document

CRM-M-23941 of 2015 -2came on parole in November, 2014 which was to expire on 10.12.2014.

The marriage of the petitioner was solemnized with Kuldeep Singh @ Kallu on 09.12.2014 and Kuldeep Singh is said to have jumped his parole.

The petitioner is in custody since 19.02.2015 and it will take time in conclusion of the trial.

In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of trial Court.

Allowed in the above terms.
