-.- JAISHREE THAKUR J. (ORAL) CRM No.13927 of 2021 For the reasons stated in the application, the same is allowed and the hearing of the main petition is preponed from 06.07.2021 and is taken up for hearing today itself.
CRM-M No.16631 of 2021 This is a petition that has been filed for grant of regular bail to the petitioner in case FIR No.01 dated 19.02.2021 registered under Section 7 (Sections 49, 88 added later on) of the Prevention of Corruption Act at Police Station SVB Hisar, District Hisar.
Learned counsel for the petitioner herein would contend that the petitioner herein is in custody since 19.02.2021. It is argued that in fact the matter has been investigated and the challan stands presented and therefore, custodial interrogation of the petitioner would no longer be required.

CRM-M No.16631 of 2021 (O&M) -2instructions from Inspector Dharamvir would submit that there is enough material available against the petitioner herein to hold him guilty of all charges framed. It is further argued that there is an audio recording available with the investigating officer, which would reflect that a demand had been made by the petitioner for preparing the seniority list by which the complainant stands promoted.
I have heard learned counsel for the parties. Keeping in view the fact that the challan stands presented and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond of Rs.1 lakh to the satisfaction of concerned trial Court/Duty Magistrate. The petitioner would also furnish an undertaking that he would present himself before the Investigating Officer as and when called and would furnish his voice sample for matching with the voice in the audio recording. However, any observation made herein shall not be construed to be an expression on merits of the case.
