**** RITU BAHRI , J. (Oral) Learned counsel for the petitioner prays for quashing of F.I.R No. 379 dated 20.08.2007 registered u/s 308/341/148/149 IPC (later on challan presented under Sections 352/323/341/148/149 IPC) at P.S. Sadar, District Patiala (P-1) on the ground that the complainant in his examination in chief has stated that the petitioner was not present at the spot and no role has been attributed to him for giving injury. He was further not identified by the complainant. Out of 20 prosecution witnesses, 15 have been examined. Now, the State has moved the application under Section 319 Cr.P.C for summoning additional accused on 12.12.2014, which is pending.

Since the trial is at the fag end, no ground is made out for quashing of F.I.R.

Faced with the situation, learned counsel for the petitioner wishes to withdraw the petition.

Allowed as prayed for.

Dismissed as withdrawn.
