This matter is being taken up for hearing through video conferencing due to the outbreak of the pandemic, COVID-19. Petitioner in this case apprehends his arrest due to a complaint moved against him by respondent No.3 before the Senior Superintendent of Police, SAS Nagar, Mohali. It is submitted that the dispute between the parties is purely civil in nature and a criminal colour is deliberately being given to pressurize the petitioner.

CRM-M No.12376 of 2020(O&M) [2] registered against the petitioner on the basis of a complaint moved by respondent No.3. Therefore, she prays for dismissal of this petition being premature. Heard learned counsel for the parties.

It is not in dispute that an inquiry is pending before the police authorities on a complaint filed by Kamalbir Singh Sekhon against the petitioner, though no FIR has been registered till date. Therefore, keeping in view the facts and circumstances as above, it is directed that in case an FIR is registered against the present petitioner on the basis of the allegations in the complaint filed by respondent No.3-Kamalbir Singh Sekhon, the petitioner be served with an advance notice of three days before any coercive action is taken against him. Petition is accordingly disposed of.
