(ORAL) By way of present petition filed under Section 482 CrPC, prayer has been made for directing respondent No.2 to present the final report of investigation in case of FIR No.167 dated 20.10.2013 registered under Sections 364 and 34 of IPC (Section 302 of IPC added subsequently) at P.S. Dhariwal, District Gurdaspur and for further directing learned Illaqa Magistrate, Gurdaspur to dispose of the same wherein, previously also final investigation report was presented thrice, however, the same was returned back by the trial Court vide orders dated 11.03.2019 (Annexure P-4), 22.03.2022 (Annexure P-6) and 26.09.2023 (Annexure P-7).

Learned State counsel, on instructions, informs that though, investigation now again stands concluded, though, despite all sincere efforts, the complainant has failed to join the investigation. He further informs that a fresh final investigation report shall be presented before the Illaqa Magistrate within a period of two weeks from today. 3.

In view thereof, the present petition is disposed of with a direction to consider and adjudicate upon the aforementioned final TEJWINDER SINGH 2024.04.20 09:48 I attest to the accuracy and integrity of this document

CRM-M-16345-2024 -2report going to be presented by the Investigating Agency before the Illaqa Magistrate while keeping in view the law exposited by this Court in case of "Harinder Pal Singh Vs. State of Punjab, 2004(2) RCR (Criminal) 307", preferably within a period o three months from today as the FIR in question pertains to the year 2013 and already a period of more than 10 years has gone by.
