(Oral) The matter has been taken up through Videoconferencing on account of outbreak of pandemic COVID-19. Petitioner Sunil, accused in case FIR No. 578 dated 24.7.2019, under Sections 148, 149, 323, 324,506 IPC and Section 307 IPC and Section 25 of the Arms Act, 1958 (added later on) Police Station Sadar Palwal, has come up in this second regular bail application under Section 439 Cr.P.C., the earlier one having been declined by this Court vide orders dated 19.11.2020.

-2The allegations in brief are that as a consequence of a dispute over a plot of land between complainant Badan Singh and the accused-petitioner. On 23.7.2019 around 7.30 PM, accusedpetitioner Sunil along with non-applicants Sukha Ram, Mohit alias Sunny and Sheela caught hold of injured Deep Chand son of the complainant and gave him six knife blows hitting on the chest and abdomen.

Learned counsel for the petitioner has contended that the petitioner is behind the bars for two years and has sought to claim that on account of COVID-19 pandemic, there is every likelihood that the trial may be prolonged.

Learned State counsel who has placed on record medical documents to substantiate the prosecution version has claimed that it was life threatening injuries and has gone through the medical records to substantiate his claim that being a serious matter disentitles the petitioner to any relief.

The medical record clearly illustrates how multiple injuries in all numbering six have come about on the person of the injured from chest till abdomen. The patient card further elaborates the depth of these injuries and it is by mere providence the victim has escaped from the clutches of the death. In view of the

-3heinousness of the offence, this Court is not inclined to allow the bail. The present petition thus stands dismissed. ( Fateh Deep Singh ) August 25, 2021 Judge 'tiwana'
