Prayer made in the present petition is for directing the respondents to count the army service of 9 years, 4 months and 10 days as qualifying service combined with that rendered in CISF by the husband of the petitioner, for the purpose of pension etc.

As is apparent from the averments made in the petition that a legal notice dated 06.09.2018, Annexure P-1, was served upon the respondents, which had not been decided. However, learned counsel appearing for the respondent-UOI has placed on record the order dated 16.04.2019, Annexure A-3 alongwith the short reply, it being an order rejecting the claim raised in the aforesaid legal notice. 3.
In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to challenge the same. 4.
