In the High Court of Punjab and Haryana at Chandigarh ......

Criminal Misc. No.M-2495 of 2016 .....

Date of decision:22.1.2016 Daljit Singh .....Petitioner v.

State of Punjab and others .....Respondents ....

Coram :

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Mr. A.K. Khunger, Advocate for the petitioner. .....

Inderjit Singh, J.

This petition has been filed under Section 482 Cr.P.C. for issuance of direction to respondents No.1 to 4 to protect the life and liberty of the petitioner and his family members from the hands of respondent No.5. I have heard learned counsel for the petitioner and have gone through the record.

At the time of arguments, learned counsel for the petitioner argued that respondent No.5 is father-in-law of the petitioner. It is stated in the petition that the daughter of respondent No.5, namely, Isha is mentally sick and under the fit of anger, she is threatening that she will implicate the petitioner and his family members in a false criminal case. A request was made to respondent No.5 to make his daughter understand not to create unnecessary scene in their family. Due to the said request of the petitioner HARPAL SINGH PARMAR 2016.02.08 11:05 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-2495 of 2016 [2] and his family members, respondent No.5 became aggressive and he also threatened the petitioner and his family members that they will be implicated in a false criminal case and he also threatened that the petitioner and his family members will be eliminated as he is having a say in the local Police.

A perusal of the petition itself shows that vague allegations have been levelled. No date, month or year has been mentioned as to when the threat was given. No particulars have been mentioned at which place, in whose presence and why this threat had been given. A perusal of the petition itself shows that there is a matrimonial dispute and this petition has been filed only for that purpose. Therefore, from the averments made in this petition itself, no ground is made out for giving direction to respondents No.1 to 4 for protecting the petitioner and his family members from the hands of respondent No.5.

Therefore, finding no merit in this petition, the same is dismissed.
