Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.51 dated 08.05.2018 under Sections 307, 34 IPC and Sections 25 and 27 of the Arms Act, registered at Police Station Kathu Nangal, District Amritsar Rural. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is named in Vineet Gulati 2018.07.05 10:46 I attest to the accuracy and authenticity of this document Chandigarh the FIR. He was stated to be armed with pistol and he fired upon the car.

CRM No.M-25017 of 2018 -2The fire hit on the little finger of brother of the complainant. Learned counsel for the petitioner contended that the complainant has given affidavit that the present petitioner was not the person who fired. Learned counsel for the complainant has no objection, if the bail is granted to the petitioner. The injury is on the little finger only. The petitioner has been in custody since 10.05.2018. The trial of the case will take long time. The petitioner is not required for any investigation or interrogation purposes as he is in judicial custody. No useful purpose will be served by keeping the petitioner in custody till disposal of the case.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `40,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
