The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.37 dated 11.8.2010 registered for the offences under Sections 302, 148 and 149 IPC and Sections 25 and 27 of the Arms Act at Police Station Talwandi Chaudharian, District Kapurthala. Notice of motion to Advocate General, Punjab. Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Assistant Advocate General, Punjab and have gone through the record.

Cr. Misc. No.M-24972 of 2016 [2] From the record, I find that the FIR in the present case has been registered on the statement of Harbhajan Singh. As per the allegations, the present petitioner by taking out pistol from his `Dabb' fired three shots on Gurjeet Singh alias Manga and one shot hit on his head and he fell on the ground.
The petitioner is the main accused and further more the trial is also complete and the case is stated to be fixed for defence evidence. Keeping in view the serious allegations levelled against the present petitioner, nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of bail. As the petitioner is in custody since 10.2.2012, the trial Court is directed to decide the case expeditiously preferably within two months by giving short adjournments and even by giving day to day adjournments, if necessary.
With these observations, the criminal miscellaneous petition is dismissed.
