SURINDER GUPTA, J.(Oral) This is petition filed by petitioners seeking protection to their lives and liberty on the ground that they have married against the wishes of parents and other relatives of petitioner No.1. As per petitioners, date of birth of petitioner No.1 is 29.06.1999 but no document in support of this contention has been filed. The date of birth of petitioner No.2 is stated to be 13.07.1996, which shows that he has not even attained the age of 21 years to be eligible to marry. However, the age of the petitioners and their eligibility to marry is not a subject matter in this petition and can be ascertained in separate proceedings. Even if, either of the petitioner is minor and is not eligible to conduct marriage, their lives and liberty is to be protected.
Keeping in view of the above facts, but without expressing any opinion on the validity of marriage of petitioners, this petition is disposed of with direction to respondent No.2-Senior Superintendent of Police, Sangrur to look into the representation dated 06.07.2017 (Annexure P-5), verify the threat perception to the petitioners and take appropriate action in accordance Sachin Mehta 2017.07.
CRM-M-24094-2017 -2with law, on receipt of copy of this order along with representation in his office.
However, it is made clear that this order will have no effect on the validity of alleged marriage of the petitioners or on any other civil or criminal proceedings instituted or intended against them under any law including the provisions of Prohibition of Child Marriage Act, 2006.
