(Oral) The instant petition has been filed by the petitioner seeking grant of anticipatory bail in respect of FIR No.41 dated 18.05.2016, registered under Section 21/22/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Sadar Malout, District Sri Muktsar Sahib as non-bailable warrants have been issued against him when he absented before the trial Court on 28.03.2018. Learned counsel for the petitioner has submitted that the absence of the petitioner on the said date was not intentional but was on account of ill-health and also on account of registration of another case against him. It has further been submitted that petitioner had also filed an exemption application but the same was dismissed. CRM-M-25044-2018 --2-- Vide order dated 05.06.2018, the petitioner had been directed to appear before the trial Court.

Learned counsel for the petitioner has today filed a photocopy of order dated 08.06.2018 which shows that the petitioner had surrendered before the trial Court and furnished bail bonds. The aforesaid position is not disputed by learned State counsel. In view of the fact that the absence of the petitioner on 28.03.2018 was the first instance of default on his part, the petition, as such, is accepted and interim directions issued by this Court vide order dated 05.06.2018, are hereby made absolute subject to the condition that the petitioner shall appear before the Investigating Officer as and when directed.
