The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 73 dated 01.06.2015 registered for the offences punishable under Sections 15 NDPS Act (Section 25/29 of NDPS Act added later on) at Police Station Harike, District Tarn Taran. Heard.

Learned counsel for the petitioner submits that on 23.05.2017 petitioner was in custody in case bearing FIR No. 89 dated 01.05.2017 registered for the offence punishable under Section 15 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Sadar Ferozepur. In that case, he was released on bail on 09.06.2017. Notice of motion.

Perusal of the order dated 09.06.2017 (Annexure P-4) passed by Judge Special Court, Ferozepur shows that the petitioner in case bearing FIR No. 89 dated 01.05.2017 was released on bail on 09.06.2017 and was in custody when his absence was marked and non-bailable warrants were issued in case bearing FIR No. 73 dated 01.06.2015 registered at Police Station Harike, District Tarn Taran. Keeping in view the above fact, this petition is allowed and petitioner is directed to surrender before the trial Court within a week and on his appearance he be allowed bail to the satisfaction of concerned trial Court/Duty Magistrate subject to the condition that petitioner shall appear before the concerned Court on each and every date of hearing.
