******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.547 dated 23.12.2016 registered for the offence punishable under Section 420 of Indian Penal Code (for short, "IPC") at Police Station Ambala City, District Ambala.

Heard.

Learned State counsel submits that as per complaint lodged by complainant-company, a cheque of complainant-company bearing no. 622899 dated 18.11.2016 drawn on Union Bank of India for a sum of `6 crores with forged signatures of its authorized signatories Ajit Singh was presented in bank by Harbhajan Singh. This cheque was given to Harbhajan Singh by one person, who had entered into agreement to purchase his land. Amrik Singh and petitioner Jasbir Singh @ Jassi were signatories to that agreement and as per Harbhajan Singh, the entire deal was finalized at their instance.

CRM-M-2511 of 2018 -2Cheque of `6 crores was not honoured by the bank. The person, who has given the cheque, is still to be arrested. The petitioner was arrested in this case on 05.08.2017 and is in custody since then. Challan against him has already been presented in Court. The matter against other accused is still under investigation. In view of above but without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, the present petition is allowed. Petitioner-Jasbir Singh @ Jassi is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
