******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No.85 dated 26.08.2016 registered for the offence punishable under Sections 306 read with Section 120-B of Indian Penal Code, at Police Station Jathlana, District Yamuna Nagar.

Heard.

Learned State counsel submits that petitioners have joined the investigation. The other co-accused have already been allowed bail by the lower Court.

Allegations against the petitioners are that they had prompted the deceased to purchase the land, which was disputed one. He made SACHIN MEHTA 2018.08.10 17:28 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CRM-M-25114-2018 -2payment of `40 lakhs for purchase of the land and when the fraud came to his notice, he committed suicide.

The matter is still under investigation. Custodial interrogation of the petitioners is no more required.

Keeping in view the above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 20.06.2018 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioners shall make themselves available for interrogation by the police as and when required; (ii) that the petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioners shall not leave India without the prior permission of the Court;

(iv) that the petitioners will seek regular bail on the presentation of challan in Court.
