(Oral) In the present petition filed under Section 482 Cr.P.C, payer is for quashing of order dated 06.05.2016 (P-5) passed by learned JMIC Hoshiarpur whereby the application for restoration was allowed in a petition under Section 125 Cr.P.C.
The petition filed by the respondent-wife under Section 125 Cr.P.C was dismissed in default on 21.01.2013 a the respondent could not appear. When she came to know about this fact on 09.09.2013, she filed the restoration application, which was allowed by the Court below on 06.05.2016, after relying upon a judgment of Hon'ble the Supreme Court in a case of Collector Land Acquisition vs. Ms. Katji, AIR 1987 SC 135.
Learned counsel for the petitioner after arguing for some time, prays that the matter be referred to Mediation Centre for an amicable settlement. The order does not require any interference by this Court. However, the petitioner can compromise the matter in the trial Court, if so advised. The petition stands dismissed.
