Dated Police StaƟon SecƟons 14.08.2018 City Jagadhri, 174-A IPC 1.
Challenging the order of proclamaƟon, vide order dated 04.06.2018, passed by JMIC, Yamuna Nagar, due to the default in appearances before the trial court, the peƟƟoners has come up before this court.

A perusal of para 3(f) of the peƟƟon reveals that the parƟes have seƩled their dispute and the complaint under SecƟon 138 of NegoƟable Instruments Act has been withdrawn vide Annexure P-5. A perusal of Annexure P-5 reveals that on 15.07.2019, Judicial Magistrate Ist Class, Yamuna Nagar had recorded the statement of complainant and dismissed the complaint as withdrawn.

Once the main complaint has been closed aŌer that in the conƟnuaƟon of ancillary proceedings under SecƟon 174-A IPC would not achieve only purpose whatsoever.

Given above, the present peƟƟon is allowed and impugned order dated 04.06.2018 is set aside and subsequent proceedings arising therefrom i.e. FIR No. 953 dated 14.08.2018 under SecƟon 174-A IPC registered as Police StaƟon City Jagadhri, District Yamuna Nagar. Bail bonds stand discharged. All pending miscellaneous applicaƟons, if any, stand disposed of.
