Prayer made in the present petition is for setting aside the order dated 28.03.2023, vide which respondent No.1 has rejected the case of the petitioners for grant of pay scale of Rs.15600-39100+5400 as being drawn by their counterparts in the same department.

Learned counsel submits that the issue already stands decided by this Court in Sarabjit Singh Khokhar and others vs. State of Punjab and others, CWP-10823-2003, decided on 04.08.2010, Annexure P-3 and in the speaking order dated 28.03.2023, Annexure P-9, the only observation made was with regard to the financial burden and without any reason recorded therein, the similarly situated Assistant Mechanical Engineers have been granted the scale.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to have a relook at the matter and decided afresh, taking note of the aforesaid judgment, within a period of 6 months, which this Court HAMANT 2025.02.17 17:50 I attest to the accuracy and integrity of this document

CWP-7723-2024 has no reason to believe the authorities would not address in a just, fair and reasonable manner.

The aforesaid satisfies the learned counsel for the petitioners. 5.

The matter stands disposed of accordingly and if the petitioners are found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same may be passed after granting opportunity of hearing to them and shall contain reasons, whereupon they shall be free to seek legal redress thereupon.
