The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 26.02.2024 (Annexure P-18) passed by Minister (Consular), Embassy of India, Paris whereby his application seeking re-issuance of passport has been rejected. 2.

The petitioner at present is living in France. He applied for re-issuance of passport. Minister (Consular), Embassy of India, Paris vide order dated 26.02.2024 has rejected his application and further observed that he would be issued Emergency Certificate, if applies. 3.

Mr. Karan Kumar Jund, Senior Panel Counsel for Union of India, who on advance notice is present in Court, submits that impugned order is an appealable order and this fact has been duly recorded in the PARAMJIT KAUR SAINI 2024.03.21 03:16 I attest to the accuracy and integrity of this document

impugned order. The petitioner may be directed to avail alternative remedy of appeal.

Faced with this, Mr. R.S.Ghuman, Advocate, submits that petitioner would file appeal and the appellate authority may be directed to decide his appeal in a time bound manner.

Mr. Karan Kumar Jund, Advocate, does not oppose aforesaid prayer of the petitioner.

In the wake of statement of both sides, the petition stands disposed of with liberty to petitioner to file appeal before appellate authority. If he files appeal within two weeks from today, the appellate authority shall decide the same within two weeks from the date of filing.
