(ORAL) The instant petition under Section 438 of the Code of Criminal Procedure has been filed by the petitioner seeking anticipatory bail in case FIR No.133 dated 26.01.2017 under Section 174-A IPC registered at Police Station City Jagadhri, District Yamuna Nagar. Learned counsel for the petitioner contends that in the main case in which the petitioner was declared proclaimed offender, he has already been granted bail on the same date on his appearance. Learned counsel further states that the Investigating Officer may be directed to release him on bail on his appearance in the aforesaid FIR. Heard.

Since the petitioner intentionally remained absent to delay the trial and forced the Court to declare him proclaimed offender and get registered a case against him under Section 174-A IPC, therefore, he does not deserve any concession of anticipatory bail. Accordingly, the petition is dismissed.
