Versus
State of Haryana ..... Respondent
CORAM:
HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. Arjun Atri, Advocate for the petitioner. RAMENDRA JAIN, J. (ORAL) 1.
In the instant petition under Section 438 Cr.P.C., the petitioner has prayed for grant of anticipatory bail in case FIR No. 119 dated 08.06.2017, registered under Sections 5/13(2) and 17 of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, at Police Station Nagina, District Mewat (Haryana).
2.
On the basis of secret information to the effect that the petitioner along with his co-accused, namely; Sohrab, Musti, Sher Khan and Jahir, was indulged in cow slaughtering and that he had tied some cows with each other for the said purpose, a raid was conducted by the police at the disclosed place. During the raid, 12 weak and thin cows and one bull total 13 in number were found tied with each other with an intention to slaughter them. However, the petitioner along with his accomplices fled away from the spot along with a plastic bag.

Learned counsel for the petitioner contends that identity of the petitioner is doubtful as he was not apprehended at the spot. His identity Rishu Kataria 2017.07.13 18:00 I attest to the accuracy and authenticity of this document
CRM-M-24274-2017 -2established by the secret informer without disclosing as to how he was knowing the petitioner prior to the alleged incident is not worth reliance. No independent witness was joined by the police at the time of conducting the raid. Even no recovery was effected from the petitioner. 4.
Considering the involvement of the petitioner in heinous crime and also the fact that the petitioner fled away from the spot, he does not deserve the concession of anticipatory bail, more particularly, when he is required for custodial interrogation to recover the articles so to be used in slaughtering cows allegedly took away by him in a plastic bag. 5.
Dismissed.
