(ORAL) On 06.12.2022, this Court had observed that the matter had been pending for two decades and time was granted to the petitioners to ascertain if they were still keen to prosecute the matter. However, on 12.07.2023, no one had put in appearance on behalf of the petitioners. Challenge in this writ petition was to the vires of Section 306(4)(b) of the Code of Criminal Procedure, 1973.

None has appeared on behalf of the petitioners even today. In the circumstances, the writ petition is dismissed for nonprosecution. However, the writ petition can be revived by the petitioners if any cause of action survives within three months.
