Through this petition under Section 438 Cr.P.C., the petitioner has sought anticipatory bail in case FIR No. 42 dated 19.05.2017 (Annexure P-1) registered under Sections 302 and 120-B IPC at Police Station Amloh, Fatehgarh Sahib.

The allegation against the petitioner is that he, in conspiracy with his real sister-Kiranjit Joshi, committed the murder of his brother-inlaw (husband of his sister), namely; Hari Pal on 18.05.2017 at village Salana Jiwan Singh Wala.

Learned counsel for the petitioner contends that the petitioner has no role to play in the murder of his brother-in-law, namely, Hari Pal. There was constant matrimonial dispute between her sister and deceasedHari Pal. The petitioner resides 50 kms. away from the place where the murder of Hari Pal was committed. At the time of murder, the petitioner was not present at village Salana Jiwan Singh Wala. 4.

CRM-M-24298-2017 -2the submissions made by learned counsel for the petitioner by submitting that the police has found the involvement of the petitioner in the murder of Hari Pal after collecting sufficient evidence including his call details. According to the call details, the petitioner and his sister-Kiranjit Joshi were in constant touch with each other prior to the murder of Hari Pal and immediately, thereafter.

Considering the overall facts and circumstances of the case and the fact that the investigating agency had found the involvement of the petitioner in the murder of his brother-in-law Hari Pal aforesaid, the instant petition being without merits, is dismissed.
