By virtue of this petition preferred under Section 482 Cr.P.C., petitioner has sought conducting of enquiry with regard to alleged false implication of his brother in case FIR No.12 dated June 26, 2015 under Sections 21, 25 & 29 of Narcotic Drugs & Psychotropic Substances Act, 1985, registered at Police Station, State Special Operation Cell, Amritsar, through some independent agency/CBI.

At the very outset of arguments, it has been emerged that after conducting of investigation in the instant case, report under Section 173(2) Cr.P.C. has already been presented and the learned Special Judge is already seized of the trial. Thus, instant petition is not maintainable and is disposed of as having been rendered infructuous. However, the petitioner shall be at liberty to take all the pleas taken in this petition before learned trial court during trial.
