Learned counsel for the petitioners submits that he may be allowed to withdraw the present petition in respect of petitioner no. 2 Karandeep Singh who is stated to have caused grievous injury to Pawanpreet Singh with liberty to surrender before the investigating agency.

Dismissed as withdraw with aforesaid liberty qua petitioner no. 2. As regards petitioner no. 1-Rachhpal Singh, it is contended that he himself suffered a depressed fracture on right temporal bone and to undergo craniotomy. According to him, it is yet to be determined which was the aggressor party. Admittedly, petitioner no. 1 has joined investigation and has handed-over the weapon as well as the license thereof to the investigating agency. Under the circumstances, order dated July 11, 2017 is made absolute in respect of petitioner no. 1-Rachhpal Singh subject to the conditions envisaged under Section 438(2) Cr.P.C.
