NIDHI GUPTA, J. (ORAL) Prayer in this 2nd petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No.179 dated 25.05.2022, registered under Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Sections 363 and 366 IPC at Police Station Rajindra Park Gurugram.

Learned counsel for the State has filed custody certificate dated 30.03.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year, 09 months and 29 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
