The petitioner incarcerated in the FIR captioned above, has come up before this Court, by filing the present petition under Section 439 CrPC seeking bail. 2.

Counsel for the State opposes the present bail petition. 3.

After arguing for some time, counsel for the petitioner submits that he wants to withdraw the present petition with clarification that trial Court be directed to expedite the trial by fixing a block date.

The petition is disposed of, having been withdrawn. Pending applications, if any, stand disposed of. However, earlier this Court had directed the trial Court to expedite the trial, but trial is still pending. Therefore, trial Court is requested to make efforts to conclude the trial on priority. It is clarified that if trial is not concluded within six months, then it shall be permissible for the petitioner to file bail application before the trial Court only on the ground of delay in trial. It is further clarified that in case the petitioner seeks any adjournment, then the time for which trial is delayed because of the petitioner or on his behalf or by instigating others, then such period shall be added in the period six months granted by this Court. Trial Court is also requested to block a date in this case.
