RAMENDRA JAIN, J. (ORAL) Despite the case having been called twice, none has put in appearance on behalf of the petitioner as well as the previous order dated 10.09.2018, has also not been complied with.
Learned counsel for the respondents prays for dismissal of instant petition as the petitioner has not paid even a single penny towards maintenance, in utter disregard to the order dated 03.12.2014 (Annexure P-4) of the Judicial Magistrate Ist Class, Narnaul, whereby the petitioner was directed to make payment of maintenance @ ` 8000/- per month. In view of the above, the instant petition is dismissed for want of prosecution.
It is, however, made clear that in case, any application for restoration of instant petition is filed by the petitioner, in that eventuality, the same shall be restored only subject to the condition that he would bring a demand draft towards total arrears of maintenance, in favour of respondents.
