This is the second petition by the petitioner seeking his enlargement on regular bail in case FIR No.56, dated 15.05.2013, under Sections 379/411/473/120-B IPC and 21/22/61/85 Narcotics Drugs and Psychotropic Substances Act, 1985 (for brevity, the NDPS Act') (Sections 468, 471 IPC & Section 25, 25A, 27, 29 NDPS Act & 25/54/59 Arms Act were added later on), registered at Police Station Banur, District Patiala. [2] The allegations is that the petitioner is member of a gang involved in stealing high-end vehicles which are then used for illicit business of drugs and narcotics. [3] It is an admitted fact that petitioner is involved in multiple cases, mostly under Sections 379 and 382 IPC since the year 2000 onwards. The details of those cases are given by the petitioner himself in para 12 of the petition.

[4] The petitioner was also admittedly involved in one more case under the NDPS Act registered vide FIR No.251, dated 10.09.2011, under Sections 18,61,85 NDPS Act, at Police Station Sector 5, Panchkula (Haryana).

[5] Though the petitioner is incarcerated for a long period but having regard to his involvement in multiple criminal cases including under the NDPS Act, we are satisfied that rigour of Section 37(1)(b)(ii) of the NDPS Act are fully attracted. No case to grant him bail is made out. [6] Dismissed.

[7] However, the Special Judge, Mohali, is directed to expedite the trial and make an endeavour to take up the case at least once in a week so as to conclude the trial at the earliest.
