The petitioners seek quashing of FIR on the basis of compromise. The FIR was registered on 29.4.2016 in a case of assault. The investigation is still in progress and challan has not been presented. Notice of motion. On asking of the court, notice has been accepted by Ms. HK Athwal, DAG, Punjab. Copy given. Counsel for respondent No.2 has put in appearance to admit that the matter has been compromised.

The petition is disposed of with a direction that it will be open to the complainant- respondent No.2 to appear before the investigating officer and offer a supplementery statement, which will be recorded by the investigating officer. It will be open to the investigating agency, on the basis of subsequent events, either to present report u/s 173(2) Cr.P.C. or to file cancellation report. In case cancellation report is submitted, the same would be considered, in accordance with law, by the concerned Magistrate.
