(Oral) This petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to petitioner Ranjit alias Ranjeeta in case FIR No.187 dated 14.11.2015 registered under Sections 148, 149, 302,307, 202 IPC read with Sections 25/27/29/54/59 of the Arms Act, at Police Station Mohana, District Sonepat. Learned counsel for the petitioner submits that there are total 34 witnesses, out of which 25 witnesses have been examined. The material witnesses have been examined and they have not supported the case of the prosecution. The petitioner is in custody since 22.11.2015. Learned counsel further submits that co-accused of the petitioner, namely, Pankaj @ Pinku has filed Criminal Misc. No. M-46276 of 2017 before this Court and vide order dated 18.05.

2018, he has been released on regular bail. Similarly, another co-accused, namely, Dharmender has also been granted regular bail vide order dated 06.11.2017 passed by this Court in Criminal Misc. No. M33581 of 2017. Co-accused-Parveen @ Kacchi has also approached this NEETU RANI 2018.08.08 10:35 I attest to the accuracy and authenticity of this document Chandigarh Court by way of filing Criminal Misc. No.

Criminal Misc. No. M-25341 of 2018 released on regular bail vide order dated 31.05.2018. The trial may take some time to conclude.

Learned State counsel has also not disputed the custody period as well as examination of 25 witnesses and also grant of bail to abovesaid co-accused.

Heard the arguments of learned counsel for the petitioner and have also perused the contents of FIR and the documents available on the file.

Keeping in view the submissions made by learned counsel for the petitioner and also the fact that all material witnesses have been examined and co-accused, namely, Pankaj @ Pinku, Dharmender and Parveen @ Kacchi have been released on regular bail; the petitioner is in custody since 22.11.2015; no purpose would be served by keeping him in custody and the trial may take some time to conclude, this petition is allowed and the petitioner (Ranjit alias Ranjeeta) is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court.
