Petitioner seeks concession of regular bail in a case registered against him under sections 419, 420, 467, 468, 471 & 120B IPC vide FIR No. 50 dated 01.04.2015 at Police Station Sector 3, Chandigarh.
Learned counsel for the petitioner submits that case is triable by Magistrate and petitioner has been in custody for a considerable period. He is, thus, entitled to concession of bail. Prayer has been opposed by learned State counsel. According to him, allegations against the petitioner are serious. His plea deserves to be dismissed.
I have heard learned counsel for the parties. It appears that a secret information was received by the police that a person impersonating as Akash Gupta claimed that he was employed in Punjab and Haryana High court as steno-typist. He was cheating innocent litigants in the High court by promising to help them. Believing the information to be correct, investigating agency started investigating and apprehended the accused. CRM M-24373 of 2015 found that real name of petitioner was Sawan Kumar Gupta s/o Ravinder Gupta. He claimed his name to be Akash Gupta and working as a steno-typist with a High court Judge. He also showed a character certificate purported to have beeen issued by the said Judge which was found to be forged.
In view of gravity of offence and seriousness of the allegations, I am of the considered view that petitioner is not entitled to concession of bail. Petition is hereby dismissed.
