This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 164 dated 20.06.2013 under Sections 498-A, 406 IPC at Police Station Rajendra Park, Gurgaon.

Learned counsel for the petitioner at the outset submits that a compromise has been arrived at between the parties and matrimonial dispute has been settled.

Learned State counsel has produced certified copy of the order passed by the District Judge, Family Court, Gurgaon whereby petition under section 13-B of the Hindu Marriage Act, 1955 has been accepted and marriage between the parties has been dissolved by mutual consent. Certified copies of joint statement of petitioner and complainant have also been produced. The order and joint statement are taken on record as mark 'A' and mark 'B'.
